PROCEDURE FOR THE POSTPONEMENT OF THE MILITARY SERVICE

 

1. Whose military service can be postponed?

 

The military service of the following can be postponed:

 

a. Those whose bodies are not developed enough for military service.

 

b. Those with health problems considered as curable in time or with medication consequent to the examination by the roll-call committee doctors.

 

c. Those whose brothers are ascertained to be serving in the army during the roll-call (upon request).

 

d. The students the continuation of the education of whom are documented by the principal of a high school or an equivalent thereof and the students the continuation of the higher studies of whom are proved by official documentation to be issued by the ministry of National Education and Culture.

 

2. Are there any time constraints with respect to postponement due to high school or university study?

There are time constraints for study-related postponement.

 

The postponement of:

 

a.Those who attend a higher education institution without compulsory attendance (i.e. open universities) and fail for 2 consecutive years and those who attend a pre-higher education preparatory class shall not exceed 2 years,

 

b.Those having a 2-year study, shall not exceed 4 years,

 

c.Those having  a 3-year study, shall not exceed 6 years,

 

d.Those having a 4-year study, shall not exceed 7 years,

 

e.Those having a 5-year study, shall not exceed 8 years,

 

f. Those having a 6-year study, shall not exceed 9 years,

 

g.Those who attend a high school or an equivalent thereof shall continue until the age of 21,

 

h.Those who continue their higher education shall continue until the age of 30 at the most.

 

3. What should those whose postponement ends do?

 

Those who are subject to postponement and who have completed or have decided not to complete their study, graduate study or internship must have the required registration made by applying to the Recruiting Office within three months following their graduation date or the date they have decided not to complete their study, graduate study or internship and those whose postponement continues within three months following the date their postponement shall expire. Those who do not observe those time periods shall undergo the procedures for pre-registration draft evaders.

 

4. Are there any time constraints with respect to postponement due to graduate study?

 

a. Those who apply for reserve officer pre-candidacy after graduation from an academic institution that bestows such right and prove that they have gained the right for a study or a graduate study higher than that of a faculty, academy or school at a particular field with an official document to be issued by the Ministry of National Education and Culture before joining the training unit are granted the right to postpone their military service obligation for a period of one year.

 

b. The postponement of those who have been granted such right and whose study or graduate study will continue for more than a year can be extended for a period of one year each time, provided that they prove this situation with an official document to be issued by the ministry in charge of education and teaching before the end of the postponement period.

 

c. Those who can prove with an official document to be issued by the ministry in charge of education and teaching that they have to do an internship for a maximum of one year right after their graduation for the performance of their profession are entitled to one-year postponement for one time only. This period of time in any case whatsoever, can n ot be so as to exceed the date the person will reach thirty-two years of age or be more than twice the shortest period that the graduate degree can be completed.

 

5. What is the duration of postponement and residence in the Turkish Republic of Northern Cyprus for those under special status due to completion of higher education (paid military service)?

a. By applying to the Recruiting Office each year in writing and by proving that they work in accordance with the provisions of the TRNC military law as well as the laws of the country they are in, they can postpone the military service obligation up to four years and stay in the Turkish Republic of Northern Cyprus so as not to exceed 120 days in total each year.

 

b. They are required to keep the postponement documents they shall receive from the Recruiting Office in their possession each time they shall enter and exit from the Turkish republic of northern Cyprus, apply within 12 months following the end of the fourth year and fulfill their obligations within 12 months following the date of application.

 

c. Those who fail to apply within 12 months without a legitimate excuse and those who fail to fulfill their obligation within 12 months following the date of application can not benefit from the right to paid military service. Those who become post-registration draft evaders lose their rights.

 

6. Can the military obligation of those who have been entitled to receive education while doing their military service be postponed and can one continue the education?

 

Those who can document that they have been entitled to receive higher education, high school education or equivalent thereof while doing their military service are released provided that they shall complete the remaining service period by applying within six months following the date their education shall end at the latest.

 

7.  Who can not quit the military?

   

    Those who earned the right to be a reserve officer by graduating from a college or faculty and are serving as reserve officers 3rd lieutenant or Sergeant ranks) do not have the right to break off their military service duty.
